The Service provides tools and technology that allow Users to search for, identify, and download Avatars that they have previously created, used, or have legal rights to from various platforms or sources. The Service is a personal recovery tool, not a distribution or third-party service.

3. User Eligibility and Account
You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use this Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Core User Obligations and Restrictions

4.1. Solely for Personal Use
You agree to use the Service only to recover and download Avatars that you personally own or have the explicit, legal right to use. An "Avatar" is defined as a digital representation that you have created, commissioned, or legally acquired for your own use.

You must not use the Service to recover, download, or access Avatars on behalf of any other person, entity, or third party. This includes, but is not limited to:

• Downloading an Avatar for a friend, family member, or client.

• Using the Service to harvest or collect Avatars belonging to others.

• Operating a service that uses our technology to provide avatar recovery to others.

4.3. Representation of Ownership and Rights
By using the Service, you represent and warrant that any Avatar you attempt to recover or download is your own. You affirm that you are the original creator, the rightful licensee, or otherwise have the legal authority to possess and use that specific Avatar.

4.4. Prohibited Conduct
You agree not to use the Service to:

• Infringe upon the intellectual property rights, privacy, or publicity rights of others.

• Recover Avatars that are illegal, obscene, defamatory, or promote hate speech.

• Reverse engineer, decompile, or attempt to discover the source code of the Service.

• Use any automated system (e.g., bots, scripts) to access the Service in a manner that sends more request messages than a human could reasonably produce.

5. Intellectual Property
The Service and its original content, features, and functionality are owned by Avatar Recovery and are protected by international copyright, trademark, and other intellectual property laws.

Regarding the Avatars you recover: You retain all ownership rights to the Avatars you download using our Service. We claim no intellectual property rights over your Avatars. You are solely responsible for ensuring you have the rights to the Avatars you recover.

6. Privacy
Your privacy is important to us. Our Privacy Policy, which explains how we collect, use, and protect your personal information and Avatar data, is incorporated into these TOS by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these TOS. Upon termination, your right to use the Service will cease immediately.

8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL RECOVER EVERY AVATAR YOU SEARCH FOR.

9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AVATAR RECOVERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

10. Indemnification
You agree to defend, indemnify, and hold harmless Avatar Recovery and its licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Service.

• Your violation of any term of this TOS.

• Your violation of any third-party right, including any copyright or other intellectual property right, related to an Avatar you recovered. This specifically includes claims arising from you downloading an Avatar you did not own.

11. Changes to Terms
We reserve the right to modify these TOS at any time. We will provide notice of changes by posting the new TOS on this site and updating the "Last Updated" date. Your continued use of the Service after any change constitutes your acceptance of the new terms.
